Methven USA Inc., a Wisconsin corporation ("Methven") hereby warrants (the "Warranty") that all products sold by Methven shall be free from manufacturer's defects in material and workmanship. This Warranty will only apply to products purchased and used in the United States of America.
This Warranty extends to the Product only for so long as it is used for normal residential purposes and only for so long as the original consumer purchaser of the Product owns the home in which the Product was originally installed.
If the Product is used commercially, this Warranty will expire one year from the date of purchase.
Methven will repair, at NO CHARGE or, at its option, replace any Product or part of the Product which proves defective because of improper workmanship and/or material, under normal conditions of installation, use, service and maintenance. If Methven is unable to provide a replacement and repair is not practical or cannot be completed in a timely fashion, Methven may elect to refund the purchase price in exchange for the return of the Product. In no event shall Methven's liability exceed the purchase price of the Product.
This Warranty is strictly limited to defects in parts and/or finish. LABOR CHARGES AND OR DAMAGE INCURRED IN INSTALLATION, REPAIR OR REPLACEMENT, AS WELL AS ANY OTHER KIND OF LOSS OR DAMAGE ARE EXPRESSLY EXCLUDED. Damage caused by accident or by the misuse or abuse of the Product is not covered by this Warranty. Damage caused by the use of cleaners containing abrasives, alcohol or other organic solvents, whether performed by a contractor, service company, or the individual consumer purchaser, are excluded from this Warranty.
TO THE FULLEST EXTENT PERMITTED BY LAW, METHVEN IS PROVIDING THIS WARRANTY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. METHVEN EXPRESSLY DISCLAIMS ANY LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
Proof of purchase (original sales receipt) from the original supplier of the Product must be presented to Methven for any Warranty claim to be valid.
Some states, provinces and nations do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of such damages, so these limitations and exclusions may not apply to you. This Warranty gives you specific legal rights. You may also have other rights which vary from state to state, province to province, nation to nation.
